The question of whether IT/ITES-based units are 'Industry' or not is still being debated in India. There is no conclusion arrived at. There is widespread opinion in favor of recognizing these units as 'Industry' growing. Therefore, until proper amendments are issued, the IT/ITES units are to be registered and governed under the Shops & Commercial Estts. act of the respective states only. Therefore, in Maharashtra, the Bombay Shops & Comml. Estt. Act will be applicable, including labor-related regulations. Read the bare act attached.

The Bombay Shops and Establishment Act, 1948 has been repealed, and the new Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017 has come into effect from 7th September 2017.
