Please find attached the Maharashtra Shops & Establishments (Regulation of Employment and Conditions of Service) Act 2017, notified on 7.9.2017. The important features are as follows:

- It will come into force on a date to be notified.
- The Maharashtra Shops & Establishments Act shall stand repealed.
- It will apply to all establishments (other than factories).
- Provisions on the lines of the Factories Act have been incorporated in this Act.
- All establishments need to apply for online registration and will receive a Labour Identification No. (LIN).
- Identity cards are to be provided to all workers.
- Rules regarding hours of work, overtime, compensatory off, etc., are provided for.
- Leave rules are specified, including the accumulation and encashment of leave and eight paid festival holidays.
- Provisions for the health and safety of workers are included.
- All establishments are required to file an annual return.
- The government will appoint a Chief Facilitator under the Act.
- Rules will be framed by the government under the Act.

Hi,

Please share the new Gratuity Act for Maharashtra. According to the previous act, an employee needs to be continuously working with the company for 5 years to be eligible for Gratuity. After completing this period, he will be eligible for Gratuity.

Under the new act, an employee needs to be continuously working with the company to be eligible for Gratuity.
