Hi, we are a software based firm with 10 employees located at Mumbai. Would like to know is it mandatory to issue salary slip to employees and if yes it comes under what provision/law ?

Hi Software companies will fall under Shops & commercial establishment act. As per the regulations of Shops & commercial establishments it is mandatory to issues pay slips to the employees.

Also, one must take care of the employees. Forget whether it is a mandate or not, the salary slips do come handy when an employee applies for a loan or a credit card.

this is a side question - How long should one keep their salary slips. I have kept all of mine, but when staff ask me for how long and why, I do not have a clear answer because I am not sure myself.

Now a days everybody is asking for salary slips for getting personal loans, vehicle loans, for giving surety to others, housing loans, getting consumer durable
items on hire purchase etc. It is a must to give salary slips to employees. It is also mandatory.

Dear All

As per the Minimum wages Rules, Contract rules and factories rules , Wage slip is mandatory, Wage slip should Issue the atleast one day prior to the distribusement of the wages because employees should know the earned wages and deducation,If any changes /mistake in respective month wage employees revrt on the same to HR Dept .

Under Minimum Wage rules

26. Form of registers and records.

(2) A wage slip in Form XI shall be issued by every employer to every person employed by him at least a day prior to the disbursement of wages.

(3) Every employer shall get the signature or thumb-impression of every person employed on the {register of wages} and wage slip.

Under CLRA rule of wage slip

78.Master Roll, Wages Registers, Deduction Register and Overtime Register.- (1)(a) Every Contractor shall in respect of each work on which he engages contractor labour,-

(i) Maintain a Muster Roll and a Register of Wages in FormXVI and Form XVII respectively:

(b) Every contractor shall, where the wage period is one week or more, issue wage slips in Form XIX, to the workmen at least a day prior to the disbursement of wages;

Salary Slip/Wage Register is mandatory as per Shops & Establishment,Factory,Minimum Wage Act etc., since your company is into software, you can easily develop the Payroll package instead of maintaining manual wage register. Few of your employee must be coming under Income Tax bracket, for filing I.T. Return a consultant will be asking them the salary slip. It is hence advisable to give salary slip
