The important things in a Consultancy Contract are:
- Commercials: Our standard rates are 0 to 4 years - 8.33%, 4 to 8 years - 10%, > 8 years - 12.5%. Taxes are charged extra.
- Guarantee Period: Usually for IT & Non-IT its 90 days from the DOJ. But for ITES sector its only 30 days.
- Payment Schedule: Usually the Payment has to be released within 30 days from the date of the Invoice.
- Validity of the Agreement: Usually 1 Year.
- Arbitration Clause: Usually settled at the courts of your City.
- Responsibilities of the Client (You) and the Consultant have to be clearly seggregated.
- Important Communication: All important communications shall be in written and no verbal communication shall be entertained.

When preparing consultancy agreement you add the following information as suggested in the initial proposal.
•Name & address of the parties of which are having agreement
•Purpose of the agreement
•Detailed start & finish of the agreement
•No of employees evolved in the agreement ( 1 or 2 or 3 consultants)
•What are the expectations from the consultancy company
•No of hours required to work
•How much they are been paid
•What are the deliverable
•What are the causes of termination of agreement
•Should any of the clauses in the contract is being breached what are the actions to be taken
•Confidentially agreement clauses
•Attach the CV or company profile
•Signatory one representative of each party of sign plus witness and a legal advisor
