Dear All, My entity employed 20 employees (Workman-9, Managerial, and Supervisor-11) the CLRA Licenses applicable or Not?

You engage managers and Supervisors also as CONTRACT LABOUR?????? What a tragedy and that also in KERALA?

First of all the Licence under CLRA is applicable only to the contractor and it is issued by the Labour department on satisfying the purpose of engaging workers on contract. here the purpose of engagement is not clear. You have written that your ENTITY has employed..... What do you mean by entity? Is is that you are principal employer and you have appointed somebody as contractor who has engaged or deployed (not employed) a few of his employees in your establishment?

One thing more. You asked the question on 29th July and we responded immediately. You managed to find time today, ie, after eleven days! If you work like this, I am very sorry to say that you will not succeed in HR career!

Reality is many organizations are engaging contractual supervisor, Application engineers, Managers etc. through 3rd party payroll other than worker including Nationalized and private Banks.

There are organizations whose business nature is not only to sell product but also to provide services. In Power Plants, Steel Plants, Cement Plants etc. where employees of many other organizations are engaged who are for Project works, continuous basis service etc. done by the Contracted organizations including their sub contractors. Example:-

Refractories Organizations supply refractories to steel plants, cement plants etc. and also provide services by their own people(Managers, engineers etc.) and also though sub contracted people( Supervisors, workmen and in some cases even managers). To PE who ever entering at the plant are contractual employees - may be manager, officer, application engineer, supervisor and workmen.

Organizations under Tata Group are asking for Labour licence, compliance under CLRA Act for all employees irrespective of their nature of jobs. But there are others who are satisfied only with workmen and some others including supervisors level also regarding CLRA Act compliance.

Reality is above and complications are there with no full proof solutions.
