Dear All
Need some clarification on change in Employer & Employee contribution to PF:
Employer and employee is currently contributing 12% of basic into PF (basic being higher than Rs. 6500/-); and employee now wants to restrict his/her contribution now to only 12% of Rs. 6500/- basic, ie. Rs. 780/- pm.
Purpose behind this request is that the employee wants a higher take home package. [ He will get his the amount from his reduced PF deductions plus the employer's reduced contributions as increased take home (net) sal.]
What are the implications from a statutory standpoint to implementing this change?
Please let me know the procedure of changing contribution from maximum to minimum
Appreciate some inputs on this

Dear Bharati
Since any request for contributing on higher pay (More than Rs.6500/-p.m) shall be considered by the P.F Dept only on joint request by the employee and the employer under Para 26 of the P.F Scheme, similarly when an employee desires to revert to the statutory limit of Rs 6500/- , it shall, also be, in my view, by the joint request by the employee nad the employer to the P.F Dept.
Even after so reverting to the lower limt of pay, the P.F Act is complied and therefore , I do not tenvisage any problem in respect of any breach of the Act.

Dear Krishna,
You have calculated the PF contribution for Rs.6,500/-. Here you are abiding as per PF act. So there is no issue you can contribute Rs.780 on either side.
Just inform the Inspector that you have kept Rs.6,500/- as the wage ceiling for PF calculation for employees.
