Dear All,

If any worker drawing wages of Rs. 22,000 per month is absent due to sickness and takes 2 to 3 days of unpaid leave every month, should we remit contributions for ESIC coverage as a voluntary contribution? Is the worker eligible for medical, sickness, extended sickness, enhanced sickness, super specialty for IP & Family, temporary disablement, or permanent disablement benefits considering the circumstances?

Hi,

If the gross salary of the employee is greater than Rs. 21,000/-, then ESI deduction is not required. Based on the employee's choice, he can't enroll in ESI.

Also, please note that if the wage of an employee exceeds the wage limit of Rs. 21,000 after April or October for the respective contribution periods, then the employee continues to be an employee until the end of that contribution period.

Wages can be adjusted to accommodate the employee to get the ESIC entitlement. However, there is a minimum period of contribution specified for availing benefits. This is, however, subject to the consent of the employee and employer.
