If an employee dies while on duty, whether he will be eligible gratuity up to his date of death or till his retirement period?
Dear Mohanasundaram,
In the case of the death of an employee while in service, the completion of a minimum qualifying service of 5 years continuous service is not required. However, the nominee or legal heir of the deceased employee would receive gratuity for the service rendered by the employee up to the date of his death only.
Certain progressive employers take up a special insurance policy for gratuity with full life cover up to the age of retirement by paying an additional premium. In this case, only gratuity would be payable until the date of retirement, regardless of the number of years of service rendered on the date of death while in service.
