We have recruited some new employees in our organization. Our MD does not want to issue an appointment letter to newcomers. According to him, if we issue an appointment letter to newcomers, we have to enroll their names in the ESI PF account. We have mentioned in the appointment letter that they are in the probation period for 1 year.

So, my query is - is it mandatory for newcomers to enroll their names in the ESI PF account from the very first day of their employment?

Hi,

How is it that you issued an appointment letter but have not issued it? Your first sentence contradicts the second, wherein you mentioned that in the letter it is stated as 'probation period'. However, being in a probationary period is no bar for ESI or PF inclusion. Only apprentices are exempted from ESI, but not trainees/probationers. If any affected employee takes up the issue with the local labor office, it will definitely create unwanted issues for your company. It is better that you try to convince your management to adhere to the rules and regulations. Prepare notes and send them over to your management, stating the rules as they are and the related sections. Try to do your part in convincing them to act immediately.
