I was working for a small company and after working for 8 months resigned due to medical issue and didnt served notice period and got my relieving letter...while background verification was conducted by my current organisation hr from previous organisation stated documents are correct but I AM NOT REHIRABLE BY THEM DUE TO ME TAKING LEAVES.... now my current employer is stating BGC has failed and I am asked to leave... is this even correct????

Pl.be aware, the last & crucial phase of formalities for engaging an employee is BGC. When a candidate fails this test it's not possible to reverse or contest it, unless you have a strong case to counter a 'Not hireable' report which is not practical. So you will have no recourse to having relieved you after your failed BGC. Many a time you may not be informed about on what reason they got a bad reporting by BGC. You'll have no right to insist either the erstwhile employer or current employer to reveal the contents of the BGC. Therefore you should look out for a prospective employer who would not go for BGC or should scout for offers using a reference highly influential.
