I want to know what the employee rights are if he resigns during the probation period. Appointment letter conditions are mentioned below:

"You shall undergo probation for a period of not less than three (3) months during which the company may, without assigning any reason whatsoever, terminate the employment herein by giving notice in writing of not less than five (5) business days or payment of gross salary in lieu of the said notice."

As the conditions only favor the employer.

Yes, 5 days notice is applicable in your case because of probation period clause and if you don’t follow rule , company may recover/ deduct 5 days salary from you.

As notice period of 5 days clause is there for termination of contract for employer then as per nature of Justice same period is applicable for you too.
