1. Sir, I understand that there is no standard format of a letter via which you can request ESIC to permanently close the Code Number already allotted. Every establishment has separate facts. Accordingly, any employer who has closed their unit permanently can write a letter to the appropriate office of the Regional/Sub-Regional Office of ESIC, detailing the facts of permanent closure, etc. The code number, however, cannot be closed in case there is a sale of the unit to another party. In such a situation, I believe the old code number will continue if the facts are similar.
2. However, as proof of permanent closure, the department will require evidence such as deregistration from authorities under the Companies Act, a copy of the dissolution deed of partnership, permanent disconnection of the electricity connection, and documents showing the sale of machinery, among others.
3. It is further submitted that the department will not permanently close the code number until all dues are cleared, and an up-to-date inspection of records is conducted by the authorities of the said department.
