Good news for lady employees: Maternity leave under ESIC has been increased from 12 weeks to 26 weeks. Notification dated 20.1.2017 amending ESI (Central) Rules 1950 is attached for your reference.

Thank you for sharing valuable information. Could you confirm the applicability of maternity leave to other women who are not covered under ESI? The Maternity Benefit Act proposed an increase in the leave period to 26 weeks from 12 weeks, but the bill is still pending approval. Please provide more insight into this issue, and if the bill is passed, kindly share the copy of the Government Resolution/notification.

What about females who are already on maternity leave? Since the date of publication is the effective date, does it not apply to females who are on maternity leave? Please share your opinion.

Hi,

I would like to know if employees who have already proceeded on maternity leave (i.e., 84 days) and were due to join this month or next month will also be entitled to the extended maternity leave as per the new amendment.
