I am posting on behalf of my sister. She is a Senior Executive at a private limited listed company for the past 2 months. Prior to this role, she was a Management Trainee for 1 year. Upon joining the company, she signed a two-sided agreement stating that she would have to pay six months' gross salary if she resigns before 36 months.
Recently, she decided to resign on 26th April 2016 due to mental harassment by her immediate reporting manager for the past 6 months. In the acceptance letter, the company stated that she must pay six months' salary based on her current Cost to Company (CTC), which is higher than what she was earning during her training period. Despite having a good job profile, the mental harassment has taken a toll on her well-being, and she no longer wishes to continue working there.
The agreement also mentions that the company has the right to publish advertisements in newspapers regarding any breach of contract by the employee. She is feeling increasingly depressed as nobody in the company is willing to listen to her concerns. Her boss has indirectly threatened legal action if she fails to pay the required amount.
Please provide guidance on how to proceed in this situation.
