In our copmpany one of the employee, hr informed him to go out of the company two months notice period also given to him.. no writing only oral, but he told that he will send a resign letter after a month, last month his salary also given, till now he is not given any resign letter pls tell what mail to send him for company proof he resigned

Why was notice given orally?
What is the reason for asking employee to leave?

If you want to terminate any employee, you have a choice. Either you terminate him for due cause or convince him to resign. Most of the employees at a reasonable high post will resign as a termination letter makes it difficult to find another position.
However, if he does not resign, you need to terminate him. Your HR made a mistake by accepting that he will resign after a month.
Ofcourse without full information, we can't give any more advice

In most of the small and medium as well as single-ownership companies, there are no systems and procedures. The accounts guy doubles up as HR guy, the Admin guy doubles up as HR guy ! Most of these people do not know the basics or fundamental rules and regulation. Even the management is not keen on having such systems in place as their absence gives them enough leverage to play around with people, using them as pawns to pit one against the other. In the above company, if we inquire, we will come to know a lot of dirt and garbage. But still life goes on, business goes on... who cares !!!
