Working as an HR Executive in a manufacturing company. I have been working in this company for 1 year. No policies are followed in this company. I came to know this after joining the company, but it was my first job, that too in HR, so I have compromised myself. The company deducts PF and TDS from CTC but does not pay in actual. We show these deductions on the payslip, and there is no proof for that like PF number, Form 16, etc. I was asked to hire people from the same industry's top companies, and I was successful in that. I tried a lot to generate profits first and later convince my boss to follow all policies, but due to past mistakes done by the company, new joiners are getting negative feedback from the market, and thus some of them quit. For the remaining ones, my employer is not ready to pay traveling expenses and salaries for salespeople until they show results. Our products are new, but the prices are almost equal to top brands.

For this reason, salespeople are not able to show results in the first month itself, but my boss will not give time more than a month. He will ask me to terminate the employees. Even if I try to convince him, he will not listen to me. Sales employees who have not even received their joining expenses (they come from other states) are not ready to believe the company and continue to work after 1 month. In this situation, I don't see any growth for me in this company. All this 1 year, I tried my level best to set up things, but nothing is successful as the ultimate decision has to be taken by my boss. Now I have decided to quit the company. I did not receive the last 2 months' salary. I resigned two months back and mentioned a 3-month notice period, which my boss did not accept.

If 3 more days pass, I need to get 3 months' salary from the company. In this time, if I quit, will I be able to get my last 3 months' salary if I approach the labor office? What is the way for me to get my PF and PLI (Performance Linked Incentive), which is 10% of my CTC? Also, I don't know how to approach a new job with this experience as I didn't get a salary for the last 2 months due to the company's financial crisis, so I cannot show my bank statement for salary proof. I request all seniors to suggest what to do further???? Waiting for your valuable replies.

Let me first appreciate you for standing strong against all odds this past year despite everything going against you.

I am starting this discussion under the assumption that you have decided to leave your current company. Please don't leave your current job unless you have found another one. Don't worry about your present company not paying you; instead, just speak the truth during any interviews. If not one company, you will find another one. There is no shortage of opportunities for a hardworking person like you. There is a demand for HR professionals from the manufacturing field.

As you mentioned that PF and TDS were deducted but not paid in actual, practically speaking, you may not receive Form 16 either. The deductions from your salary may have also been mismanaged. Your boss's intentions are clear.

I would suggest that you consider taking any action against your current employer only after securing a new job. Remaining in your current company and confronting the company, especially with your boss's mindset, could prove very challenging for you.

Some company managements believe that implementing HR policies would increase costs and reduce profits. Despite your best efforts to persuade the management, it seems to have been in vain.

Therefore, think practically and prioritize securing a new job.

Dear Priya,

I don't think you can change things; step out and look for something new. In interviews, don't badmouth the organization. Just explain that the company is going through hard financial times, you have not been paid, and it is difficult to sustain yourself without a salary, so you are seeking a change.

Regarding your boss, his intentions were, are, and never will be moralistic, so stop trying to change him. As for your experience, consider it a bad dream and move on. Ideally, it is best to stick to the job while actively looking for another one.
