Dear Ms. Rajeshree,

May we know some details about your employer before we provide any insight into the circumstances:

- How many people are employed by the said employer?
- Is it just you or are others also facing similar issues with the company?
- Why did you continue working for 3 months despite not receiving payment for a couple of months in a row (Did no one raise concerns about this unfair situation)?
- Were you given an appointment letter when you joined?
- Was a bank account provided in the name of the company?

Business losses can occur anywhere. However, if your employer can still operate the business without shutting down, there may be a possibility of settling dues through Full and Final (F&F) settlements for the employees before letting them go.

Please clarify the points mentioned above to help us understand the situation better and provide a more effective response to your inquiry.

Dear Rajshree,

If you have not been receiving your salary for the past three months, how are you managing your daily expenses? I suggest searching for a new job. Sharmila Das has also provided her advice; if you have the time and resources, you can consider following her suggestions. Ultimately, the decision depends on you.

There are a lot of such entrepreneurs who just open a shop and start thinking about how to do business. Unless there is sustained business development activity, needless to say, the business will be on the decline. As the owner, he should always be focused on enhancing the business activities all the time. Once the focus is lost, the business will also nosedive.

My advice to entrepreneurs is always to have two or three connected or related business operations so that revenue will be coming from one or two of the operations to sustain survival! Now, coming to your issue, when your owner is not sure when he will be able to pay you, please make arrangements for getting an alternate job, in an established company, instead of a one-man show. Leave the present employer in a nice or amicable manner so that he responds to you at a later date for following up for your payments. Do not fight and leave. That is my suggestion. Leave at once after landing in a new job.

Best wishes

Dear Rajeshree,

I agree with all the suggestions given. Just find another good job and leave the present employer in a nice way. If he responds to you at a later date for following up on your payments, do not fight and leave.

Dear Rajasree,

I am working in a 'national' company of repute and getting my salary two to three months late! A part of my salary has not been paid since October '12! If the Central Government can act like this, what can be said about your employer?

Thank you.

Thanks, Ms. Sharmila,

We are in the Recruitment business with around 20 employees in the Thane office and one or two individuals in Delhi, Lucknow, Baroda, and some other locations. All employees are still working; they received one month's salary last week and are now waiting for two months' salary. However, he has not provided us with an appointment letter. A Karnataka bank account has been opened. Could you please explain what "F&F" means? I am currently seeking a better opportunity, but it is challenging to manage expenses without receiving a salary.

Dear Ms. Rajeshree,

May we know some details about your employer before we provide any advice on the situation:
- How many people are employed by the company?

- Why have you been working for three months without receiving payment for the past couple of months? Has anyone raised this concern?
- Were you given an appointment letter when you joined?
- Has the company provided a bank account in its name?
- Business losses are common, but if the employer can still operate without closing down, they may settle the Full and Final (F&F) payments with the employees before relieving them from their duties.

Please clarify the above information to better understand the situation and provide appropriate guidance.

I feel sorry for your plight.

Normally, when we join any job, we don't put conditions or expect any formalities such as appointment letters or any documentation in our desperation. Small-time operators do not even know what an appointment letter is. It will be like working for a Kirana merchant or Lala ka dukhan!

Problems arise when the first salary is missed or delayed. Unless there is a steady flow of business and revenue out of such business, the employer's coffers will remain empty.

No use in just opening a business unless there is a strong business sense and sustained business development and growth. Furthermore, there should be two or three related businesses going on simultaneously so that revenue flows into the company can take place, even if there is fluctuation in business due to various reasons.

In your situation, you can ask your employer nicely how consistent his payments are going to be in the future. Explain your problems and make him understand the ground realities. If he is evasive and avoiding you, it's better to simultaneously look for another job and move on.

Best wishes
