I was working as an HR Recruiter in a recruitment firm for the past 1 year and 9 months. The business was slow in the past few months, so the revenue was less. Suddenly, on November 10, 2012, we were informed by my senior manager that the management is closing the Delhi unit. They would not continue with us anymore. She asked me to resign, giving November 15 as the last date. We were not given our October salary until then. I asked for my salary; she said it would be given on November 17, 2012. She mentioned that all the employees in the Head Office also had not received their salary. It had been decided by the management that everyone would be paid on November 17. I agreed to it, and then I made a mistake. It was a mistake as I didn't seek advice from seniors. I resigned on November 12, hoping to receive my salary on November 17. After that, I inquired on November 17 about my salary. She informed me that I would get it on November 19. I called her on November 19, but she didn't answer my calls. I wrote an email to her and the director regarding my salary. I spoke to the director, and he assured me that I would receive my October salary. However, I have not received my salary until now, and the situation persists. I would appreciate advice on how to move forward and obtain my pending October salary.

well if your orgz follows all legal n compliance you will get you last month salary with fnf ,rest depends on wish of your management and your convincing skills

You can write to the company about the pending salary and keep your communications on email. Do you have a copy of your resignation? With this email and resignation copy, you can approach the labor court. I am not a legal person, but you can seek advice from some seniors who are legal professionals. Guys, please help her.

When a company is not paying or delaying salary on account of not having money to pay the same, there is little you can do except pray and follow up. Any other action is a sheer waste of money. A court case will take ages. Contacting your labor officer is of no use, as the HO is somewhere else and in any case all they will say is we are trying to get the money, etc.
