Dear Experts,

Ours is a private limited company. I would like to know the instructions of Form 11 under the PF Act. Recently, one of our employees has left our organization who was covered under EPF. After one month, he again joined our firm, and now his salary is above 6500/-. Since he is earning more than 6500/- per month, can we exclude him from EPF contributions, or is there any law under EPF to continue him under EPF rules?

Since he has rejoined after one month, there is no possibility of his withdrawing the PF dues. Therefore, you cannot exclude him even if his PF qualifying salary exceeds Rs 6500. If you provide him with Form 11, he can only write that he was previously employed in an establishment to which PF applies. In such a scenario, you cannot exclude him from PF.

Mr Madhu T K is absolutely right. As one can wait for 3 to 4 month after he resigned from the company and if he rejoins the same company there is not matter of withdrwal of PF.
