Hi all,

I have been terminated from the company due to some process issues without any notice period or one-month pay (as stated in my offer letter - either party has to give one month's notice or one month's pay). They had initially informed me that they would assign me to a different process and requested me to return after two weeks. However, after the two weeks passed, they informed me that they could not provide me with any new process and that my termination would stand. The final settlement was made without the one-month notice period pay.

I have secured a job at another company, and they are requesting my previous company's relieving letter or at least an acceptance email of resignation. Unfortunately, my previous company is not willing to issue a relieving letter, stating that I was terminated and, therefore, will only provide an experience letter.

Is there any way for me to obtain a relieving letter? Could someone please assist me in drafting a formal request for a relieving letter from my previous company? What steps should I take to obtain the relieving letter?

Dear Haya,

You can call up your Head of HR in your previous company and provide him with a newly designed Resignation Letter (pre-dated as your termination letter). You may ask him to approve it so that a copy can be sent to your current company.

Otherwise, an experience certificate (usually) would also be sufficient for your current company. This certificate will indicate your last working date with your former employers.

Sorry to hear about your termination. However, companies, at times, have to take some measures to ensure their existence.

Nevertheless, not deviating from the subject, in my opinion, your previous employer should not have any problem issuing you a relieving letter. Surprisingly, they have already issued you an experience certificate.

What is also important is whether you have stated the fact of termination to your new employer. If that is true, then the HR in your new organization would understand this.

You should, however, talk to your reporting manager in your previous organization and try to explain this. I am sure that he/she would understand your plight and oblige. You should also speak with the HR Head in your previous organization and see if he/she can help you out in this regard.
