A tea boy employed in a canteen situated outside a factory was hit by the police to disperse an unruly mob while he was returning from the factory. It was his duty to carry tea from the canteen to various persons in the factory.

Your post appears to be incomplete. Was he on his regular route back home? Was there any deviation from the regular route he takes home? Was there any prohibitory order in force at the place where the incident took place? Was the tea boy part of the mob willingly? If you could answer these doubts and also add any other information you may have, I will try to offer my views.

Please clearly explain the facts and post your queries. If he is employed there, then he will be eligible for Employees' Compensation Act claims or ESI claims, as the case may be.

Dear Renuka,

On a mercy basis, you can offer some money only by collecting from the employees of the factory as the canteen is not fixed as the factory canteen. (Hope you are having a canteen inside your factory premises as required by the Factory Act).

The question itsself is confusing or the situation which is given is illussion or would you like to know the facts, whether the tea is boy is eliglible for ESI or workmen compensation.

Dear Renuka,

The case study posted by you about the incident of child labor is incomplete. But as per your post, the two major persons responsible for encouraging child labor are:

1. The factory/tea stall/canteen where the boy is employed; the canteen owner is responsible for keeping the child as a servant/helper.
2. The parent of the child is responsible for pushing his child to work at such a young age.

Both persons may face punishment under the Child Labour Prohibition Act, 1986. We, as members of society, have a duty to stop these types of activities and encourage children to develop their careers/lives by attending school.

I completely agree with you on child education. Our society is so impoverished and ignorant that, to fulfill selfish motives, we have completely lost the base of morality. Dear All,

In the regard of the protection of poor children who are forced to become laborers, it is not only damaging the future of such children but also affecting society as a whole. When such children become young adolescents, they get cheated by either job traders or employers in terms of providing actual financial incentives/wages. We, especially the young people of society, need to take major responsibility to stop this completely. This will not only be healthy but will also enable the future growth of society, country, and individuals.
