Hello all,

Currently, I'm working in a small IT company. However, they don't provide a salary slip. I have asked about this many times, but I have not received any replies. Can I take any legal action? Please let me know. I plan to leave here as soon as possible.

Hi, There are many companies who do not provide salary slip, in that case you can ask for a salary statement from them on company letterhead and with company seal.

I agree with Mr. Somdatta. Just because of this reason, you should not leave your company. Your company is a small company, and the practice of salary slip is yet to be established. You can always suggest this point in a common meeting or HR meeting where others will also support.

Hello Balraj,

It is not compulsory to issue a payslip; there are many companies that do not provide any kind of payslip to their employees. If you need a payslip, you can request one from your HR department. If they do not provide it, try to find out the reason behind that. Alternatively, you can use your salary statements as proof.

Think of and find a better solution instead of planning to take legal action against your company, as that may not be effective.

Hi,

It is always better not to go for legal action. If you do decide to proceed, the company will provide you with a payslip and may ask you to leave. A bank statement should be sufficient if you need a salary slip for loan purposes.

Dear Balraj,

In your offer of employment letter/appointment letter and subsequently in the appraisal letter received from your HR department, you might have been provided with details of your salary and other benefits. Keep a copy in a file and take a printout of the bank statement showing the salary amount being deposited. You can use this for any loan application or other purposes if your HR department refuses to issue a salary certificate on the company letterhead. Additionally, you can use your Form 16 for further support.

If you are receiving your salary through an account payee cheque, you can request your bank to issue a bank statement, which they will provide within a few minutes. Regarding the issuance of a pay slip, even if your salary is being paid via cheque, it is necessary to provide a pay slip in the format prescribed under the Shops and Establishments Act of the state in which the company operates.

Vani, please note that it is mandatory to issue salary slips to employees as per the provisions of the Shop Act in the state.

You might have deposited the cheques issued by the employer in the bank. So that has become proof of your salary drawn. Take a printout of the bank statement and attach it along with the above-mentioned details to proceed further.
