Dear myadrenalin,

Generally, 7 NFH (National Festival Holidays) are granted including 26th January (Republic Day), 15th August (Independence Day), 2nd October (Mahatma Gandhi Jayanti), and four festival holidays such as Holi, Diwali, Dussehra, and any other festival popular in the state. Additionally, any State-level National Holiday like State foundation day is considered.

Employees are entitled to 7 CL (Casual Leave) and 7 SL (Sick Leave).

According to The Factory Act, 1948, section 79, any worker who completes 240 working days in the previous year is entitled to EL (Earned Leave). The calculation is as follows: One day for every 20 days worked for adults and one day for every 15 working days for children.

The total EL in a year is calculated as follows:

No of Days in a Year = 365 Days

No of Sundays in a Year = 52 Days
No of NFH in a Year = 7 Days
No of CL in a Year = 7 Days
No of SL in a Year = 7 Days
Total = 73 Days

Total Number of Days Absent in a Year = 73 Days
Total Number of Days Present in a Year = 292 Days
Total Number of EL in a Year = 292/20 = 15 Days

Workers may take the number of days they would normally work in a 6-week period for sick leave on full pay in a 3-year period. However, during the first 6 months of employment, workers are only entitled to 1 day of paid sick leave for every 26 days worked. Based on Legislation in Section 22 of the Basic Conditions of Employment Act.

The Leave Entitlement pattern is:

Earned leave:
1. Under Factories' Act:
One day for every 20 days worked. It works out to 15 days in a year.
2. Under Shops Act (Delhi):
Five days for every four months of working. It works out to 15 days in a calendar year.

Casual & Sick Leave:
Normally the two are clubbed to make it 12 days. Under some state laws, it is 6 days Sick Leave and 7 days of CL.

The Company I worked for:
1. EL: 30 Days
2. CL & Sick: 12 days
3. National & Festival Holidays: 12 days.
