Sir, I want to know if the union in my company, without giving notice to management, went on strike, and according to which law or section we can take action against him. Our company is limited but not government.

Section 22 of the Industrial Disputes Act provides that a strike commenced without giving 14 days' notice shall be illegal. BUT this provision applies establishments engaged in the public utility services. A public utility service mans service which should not be interrupted or interruption of which will lead to affect the life of public. Examples are public transport service including railways, work connected with ports, postal and telephone services, supply of electricity, power, water to the public, banking and such other services declared as public utilities by the government. Therefore, if your establishment comes under a public utility then you can declare the strike to be illegal.
