Hello,
My friend left the company last year without resigning (you can say that she absconded) bcause of severe health issues(severe depression, stress). She is now living in her home town and doesn't want to get back to work. After she left her job, the company sent her a termination letter. This was 5 months back and it was fine until then. But the recent developments have tensed up the situation. The company HR has sent a letter stating that as a part of final settlement she needs to pay 20000Rs to the company or else the company will launch a legal action action against her. is that possible? Can the company claim legal action against her?Pls provide your valuable advice on how to tackle the situation.

Dear Guru,
What is the clause mentioned in Appointment letter regarding absconding.
Did she possess medical certificate in that context. If she is ill why the Exit formalities not done.
If she is in possess of any valuable asset of the Organisation, please get it back and then give her notice why the disciplinary action can not be initated against her as per appointment letter.
