Can anyone help me to solve my problem please..

I have received a notice pay legal notice copy from my former employer. I want to seek a legal advice on this. As I was on probation for 6 months and I left the organization on 5th month due to instability of my health. I informed my HR also regarding my leaving over the phone and sent email also for the same,. Basically my reason for leaving the organization was tremendous work pressure and mental harassment which had led to my illness..

I need a advice on this what steps I need to take in such cases and also if anyone can help me for address and telephone contacts for labors law commissioner in Mumbai.

is there was any provision in your appointment letter that you have to give notice during probation.pls clarify this point first.
secondly ,donot worry about legal notice,they are just like that only.donot worry about labour commissioner phone numbers,be relax and chill out.no step reqd.tks

yes Mr.Malik,
it is mentioned in my appointment letter if a employee completes 3 months in the company then 1 month notice peroid is required otherwise emplyoee has to pay three months salary to them..
so what you suggest ignore the legal notice?? and the notice is copy not the original the courier is lying in post office and need to get it collected.. but I will not collect it.. i think if I do not collect they will not have record of my recival of the same...

The clause itself is wrong, it should be either one month notice or one month pay, however whenever you are asking for this type of clarifications you should send the copy of the letter also so that we can understand the contents and give you a suggestion. Normally till completion of probation ie., a minimum of six months no notice is required from both sides.

Hi,
You do not have to worry about the letter as during the probation period both the parties i.e. employee and employer are not liable to give one month notice, and in any case in any law health comes first, so no one can do anything in such circumstances.
So relax and ignore the same.

You should have communicated your resignation in a much more professional manner. In the very beginning you must have asked the HR what is the procedure if you cannot serve the notice period. Some companies request for proof of illness.
Anyways - the clause mentioned in the letter is wrong.
Since ur worry is abt the Legal Notice - please send in a copy of the letter received (email the contents) to the seniors in CITEHR who have requested you to. I am sure this shuld really help.

Have you produced doctor certificate and having come out of the company you need not bother about paying notice pay.
