Thanks a lot for your really useful informations.
I am struggling with some salaries issues for my employees. I am right now on a consultancy with a restaurant which employs more than 20 people without having received any offer letter, contrat, PF, ESI etc... Absolutely nothing.
Having an HR company, the first thing which strikes me and this is a must-know for all entrepreneur, the moment you cross 20 people in your company, you must comply with PF or ESI if we are below 20.
On top of it, and to add some more spices, no rules are fixed for the calculations of the monthly salary. The accountant is calculating the salary according the numbers of days worked. I do not understand.
What i used to do wit.h my own company is to calculate the salary and deduct the day which have been taken if they crossed the monthly quota of day. Let's say, i used to give 22 days leave a year + govt. holidays. I calculated a monthly ratio of leave (22/12) so i know how the balance for each employees and i was giving full salary every month until the person crosses his/her quota of leaves. After that, i was calculating the cost of a work day (we calculated on 22 days of work: 30 days - 8 days week end) in order to deduct the leave accordingly.
Reading your threads, i have the feeling i went really wrong. Can you enlight me on this. I feel a little bit lost...

Also my main question is :
for this restaurant, on how many days do i have to calculate the salary. Basically, we are working tuesday to sunday and monday is off. So do i calculate on a 31 days basis or on 27 days (31 days - 4 mondays)

yeah i agree with suresh ramalingam .....salary should b calculated for 30 or 31 days a month including all paid holidays ,sundays......excluding Lop days..... if i am wrong plz let me know

sweta u can pay 26 days of salary for ur employees there no issue from the labour dept. But ur company having a poilcy that they are paying amount for weekly (Rest day) then u can pay for 30 only. so first u check with ur company policy. then decided it whether to pay for 26 days or for 30 days.

Generally in payroll period, we will consider 30 days for Salary calculations like:
If 31, considering 30 Days.4 week offs ((31-4)26+4=30.
If 30, considering 30 Days.4 week offs ((30-4)26+4=30
If 28, considering 30 Days.4 week offs ((28-4)26+4=30
But If there are any LOP/Abscent you can deduct accordingly. It\'s applicable even for IT Industry(even though they are working 22days(sat&sun)(8days).
