Dear all ,
I want to have a clarity on minimum wage act ,can we bifurcate the minimum wage in to hra ,conveyance or other allowance?
I have read all the articles in Cite hr and on other sites as well but didn't get a satisfactory answer.
all the judgements are contradicting eachother.
please also confirm whose to be considered the pf department issued notifications or the minimum wage act while preparing the salary structure.
all the judgements passed are by high courts of various states. Supreme court decision is still pending on this can we consider those also?
Punjab and Haryana High Court judgement - favouring employer - 01/02/2011 stating we can bifurcate the wage
Madras High Court favouring EPFO - 07/06/2011 stating we cant bifurcate the wage it should be basic + d.a only.
your expert advice would be a great help for me..
