The salary for driver is reimbursed by the employer which means he is indirectly engaged by the employer. Hence it attracts ESI contribution. Further driver comes under the scope and defintion of 'Employee' of the ESI Act. It is prudent to cover the driver under ESI and ensure that he derives the benefits of ESI Act.

According to best of my knowledge we are booking driver salary in staff salaries account directly we have to pay the ESI to driver. In case we are booking in other heads then he is not in our on roles. Then we can't pay the ESI.

If the driver is paid by the official on his personal money, is not covered under esi/pf etc., but if the accounts personnel taken this payment in to driver's salary or any other account related to wages - it is defenitely to be treated under wages by esic.

As the direct relationship of employer and employee could not be established therefore no question of attactrating ESI. If that is the case, then PF PT LWF will be also under the the same preview.

Since the driver is not engaged by the Company and he is also under company roll, ESI need not be covered. If it is a part of reimbursement to the Manager, the driver is not coming under company roll.
