if any employee died and there is no nomination form and his wife and father are claim for gratuity by oral discussion only so what will do?

I think you have not read the entire replies before posting this query. It has been clarified very categorically that in the absence of nomination, the gratuity can be paid only to the person who is producing the legal heirs certificate. Therefore, if both the spouse and father of the deceased come forward with request for payment of gratuity, hold it and pay it once you get the legal heirs certificate.
