DEAR SIR, I'M 55 Y OLD. SERVED WITH SPARK MINDA, AS DGM-R&D AT MINDA AUTOELEKTRIK, BAWAL PLANT, TILL JUN, 2019. MYSELF WAS FORCED TO RESIGN WITHOUT ANY REASON AND RELIEVED FROM JOB. TILL DATE, STRUGGLING TO GET A PROPER N REGULAR JOB, WITH FAMILY COMPRISE WIFE & 2 DAUGHTERS STUDYING IN COLLEGE DEGREE. INFACT, I'M EVEN NOT ABLE TO GET INTERVIEW CALLS DUE TO MY AGE @55Y AND ADDED TO COVID SCENARIO SINCE MAR'20 STILL UNSTABLE FOR MEETING EXPENSES. PRIOR TO MINDA ACQUIRED IN 2016, THIS FIRM NAME WAS PANALFA AUTOELEKTRIK LTD., IN WHICH MYSELF JOINED IN 2010 THRU RELOCATION OF FAMILY & THOUGHT TO SETTLE IN NORTH INDIA TILL RETIRED 58 Y ATLEAST. UNEXPECTEDLY, AFTER THIS MNC GROUP - MINDA TOOK OVER THE FIRM, I'M RELIEVED FROM JOB, CITING NO REASONS FOR MY ACQUITTAL FROM JOB & FORCED MY RESIGNATION BE GIVEN BY THE THEN HEADS - HR & TECHNOLOGY VERTICAL. ALTHOUGH, MYSELF HAD NO NEGATIVE REMARKS OR COMPLAINTS DURING MY TENURE 2010 TO 2019 PERIOD NOR ANY DISCIPLINE ISSUE DURING MY SERVICE. INFACT MYSELF MADE APPLICATION FOR DESIGN PATENT TO MY CREDIT IN MY CAREER SINCE 1984, AFTER MY DIPLOMA MECH ENGG FROM HYDERABAD. MYSELF TILL NOT ABLE TO SETTLE INTO ANY OTHER JOB, DUE TO MY AGE BRACKET, NOR EVEN GET ANY CALLS. DUE TO WHICH, I'M & FAMILY BECOMING IMPATIENT AND STARVING FOR FOOD EVEN SOMETIMES, TO OVERCOME ANY EXPENSES AFTER THIS MANY YEARS OF SERVICE, WHICH MY CV- ATTACHED. HENCE, I WOULD LIKE TO SUE ON THIS SPARK MINDA GROUP, ON MY BEHALF TO SUPPORT ME, EITHER RE-INSTATE TILL MY RETIREMENT OR PROVIDE SOME OTHER JOB IN THEIR GROUP, OR SUPPORT THRU COMPENSATION AGAINST MY ACQUITTAL FROM SERVICE WITHOUT ANY REASON. Dear Mr Ramarao PV,

What has happened to you is unfortunate. You are facing post-takeover blues. The mergers and takeovers are always favourable to a few and unfavourable to other few. Unfortunately, you have come in the latter category.

After taking over a company, it is customary for the new company to rationalise the manpower. In the course of rationalisation, your services are discontinued. Against this backdrop, rather than wasting your time and energy in filing a suit against the company, channelise your energy in searching for a new job. Though your services are discontinued, let me believe that you have received your legitimate dues.

The threat of merger and takeover always looms over the employees. Therefore, one should be prepared to face disruption of this kind. It appears that mentally you were too unprepared and the disruption has come as a big blow to you. Nevertheless, the question that arises is at 58 anyway, you were due to retire. However, retirement has been forced upon you at 55. Therefore, a three-year early exit, though a financial setback, should not have derailed your family routine to that extent.

Yes, for the people who are 50+ getting a job is far more difficult for them. But it is not impossible either. Therefore, I recommend you prepare a list of the companies where your skills could be used and start calling them one by one. Try acquiring the details of HR and start sending them your CV. You have to do this job patiently. You may not get anything in return even after contacting a few hundred or even a few thousand companies. However, do not get dispirited.

By the way, what about sharing domestic responsibilities with other family members? At 55, you could be averaged, but what about your daughters? Are they also trying to get a job? If they also come forward, then your financial woes are expected to be mitigated.

You say you have been forced to resign. How could you be forced?
If you have evidence you resigned under force and not on your own wishes, then perhaps you have some possibility (though I would say it is unlikely) that the courts would support you. Even in the case, the lawyers fees is something you probably can't afford. note courts take 5 to 20 years for a decision.

If you have resigned, you have no recourse to say they should take you back. If you were terminated, perhaps it would be different. As Dinesh-ji says, focus on getting a new job. If you have experience, some company may be looking for it. If you have some specific skills, that is what you need to focus on

Dear Colleague,
Post globalization and the MNC culture in India, such cases during M&A happens just like that without any human values. It is a fact that many Managements does this mistake ( I use the word " mistake as it is the nearest suitable word but it is correct to say "SIN"). For a company making huge turnover and profits, it is not morally and ethically correct to kill somebody's life especially those nearing retirement and aged. But in practice they are the easy wickets and victims in this fast changing world. The Reality is painful that some one loosing job at the age of above 50 years of age. Such companies lack basic Value systems and work only on Excel sheets to see numbers / profits but they will loose reputation and sustainability in the long run.

Coming to your specific matter we could understand your feelings and the pains you and your family is undergoing. Kindly consider some of the thoughts shared by our learned Colleagues and to add few as listed below:

1. You have big responsibility on the family side and kindly do not focus on unnecessary litigation or legal case against the company which may or may not give any result but will take away lot of your time, energy, reputation and money. It is a futile exercise as the Management will go appeal after appeal. Hence re-think again and again on this.

2. You were not born to work only in this company and the world is very big. Your skill sets should help you to find next job but may be taking some time. Be patient till you find a better job.

3. Employees should never depend on any one company for life time and gone are the days of such fashions / pattern of employment. Now a days companies keep only RUNNING HORSES due to their economic run and race.

4. Never mind any company not respected you and you should have a conviction to raise up, Stand, life up by being a Free Lance Expert or by taking up next job closer to your skills. You should prove that you are not a dependent to any company but a professional. This may sound odd but this is the best way to go.

5. This is the time to proof your abilities and pick up your new venture.

6. Keep whatever earned in safe deposits of Government for a regular income and then move into next era of your life. After few years you will see your life shining and you become an independent minded professional without any affinity to attachment or dependency to any one particular organization.
