Hi, I want to know, about the ambulance room / Occupational Health center which is currently running through our company. Whether this can be run by the Charitable Trust which the company is having.

I assume this is a requirement under factory act

The act requires the facility should be available and that it should be free
Whether you run it with in-house staff, outsourced staff or have an independent trust operate it for you, would make no difference as such.

Please check the Factory rule of your State. To my opinion it can be run by Charitable Trust. But there must be overall control of the management specially when Factory Inspector will visit.

As Factory Act 1948 mentions that -
" 4*[(4)] In every factory wherein more than five hundred workers
are 5*[ordinarily employed] there shall be provided and maintained an
ambulance room of the prescribed size, containing the prescribed
equipment and in the charge of such medical and nursing staff as may
be prescribed 6*[and those facilities shall always be made readily
available during the working hours of the factory] "

- so i think it should be available in Industry premises under Ambulance room.


Occupation Health Center should be only inside the Factory premises and there is no doubt about this. Now how to manage/run the OHC - BY permanent employees, contractual employees ( which is done by majority organizations ) or outsourced to any competent third party.

There is no specific guideline under Act or any State rule who will run the OHC. There are organizations who run it by professional group. If the charitable trust has the deserving skill and competence, they can run the OHC located inside the factory premises.

Certifying Surgeons are interested to inspect medical test reports at the time of joining, periodical eye test report, periodical health check up report etc. There are organizations where is problem with ergonomics, sound (above 80 decibel etc.) Therefore, the Safety officer, manufacturing head or engaging any third party it is essential to conduct audit every quarter to check the system SOP and the records,
