Hi all,
I have 4 years of experience in IT. I am getting offers from MNC's and everything gets rejected due to BGV issue as my second employer gives a negative feedback about me. It was a very small company of 5 members and I worked there for 9 months during my initial stages of my career. The company is not a registered one and the manager's residential address was given in the pay slips. I was asked to serve 2 years of contract for which no legal bonds were asked to sign. As my marriage was fixed I had to quit my job and when I gave my resignation I was not allowed to serve the notice period. Now he is giving me negative feedbacks wherever I apply for. Please help how should I handle this problem. No documents were provided to me and he claims he has terminated me so documents will not be provided. My career gets ruined completely because of this.

The small mistakes we do at earlier stages will affect our career at later stages. Your story is one example. There were several posts like this in this forum. Whatever the company you work, even it is registered or not, when you are working and taking salary, you have to be relieved formally and properly, whether notice period clause is mentioned in the appointment letter or not. You should put a resignation letter mentioning it "with immediate effect" or "one month notice" or whatever you wish to do. You have to be bold in doing that in professional way. Negotiations would have happened in those days itself and you would have relieved properly with relieving order and service certificate. But now, you are in different position and that company position is different. Ego plays here. They don't need to do any favor to you now, as they see that you have been trained there and left, when you become a revenue generator.
You have said that you have given resignation and they have not allowed you to serve notice period. Do you have any document to show that as proof? Have you collected service certificate immediately when they have not allowed you to serve notice period?
If you don't have any of these, you have to go to his office and meet him and negotiate. If they ask you for notice period pay, negotiate and settle it and get the service certificate. This is the best way for you to come out of this situation.
If he is so adamant after negotiating with him atleast thrice and if not agreed to settle it, you can proceed legally.
You have to keep in mind that, you can bring him down to settle the issue. Legal procedure will not be a better option, which will take long time.
