1.) If any employee completion of more than 1 yr & he resigned the job (Ex.31st May 2012)
so he is eligible the EL's or not for the year Jan' 12 to Dec' 12
2.) If any employee joined in 1st July 2012 so he is eligible the EL's or not for the year
Jan' 12 to Dec' 12 (Pls mention Clause also)

Leave is a policy matter with in the framework of model standing orders/certified standing orders. So my answer for question is as follows:
(1) There is no question of granting earned Leave for a resigned employee as he is no longer your employee. However, if is claiming wages for such earned leave, you are bound to give the same.
(2) If your Company fall under definition of Factories Act, 1948, then the employee is eligible for Leave with wages @ 1 day for evey 20 days only when he completes 240 days of working. If you company falls under shops and establisment act, please refer to your state's shops and establishments act. Furhter pls also refer to your certified standing orders/ Model standing orders.
