My name is S. Nishanth I was working in akriti construction company. I left the job and gave the resignation letter to the HR. He told that he will release my full and final settlement after 1 month. It's been 1 and half month still they have not released the salary. I went and asked about salary they are saying that u have been absconded so we can't pay ur salary. Also, told me that if u want u can do whatever you want.

Dear Nishanth, What was your notice period as per appointment letter? Have you been given any acknowledgement of the resignation? Please check with him how it is treated as absconding if your resignation is accepted and acknowledgement issued.
HR has to follow due procedure for absconding cases.Talk to him and settle the matter.

Acknowledgement of resignation letter is not acknowledgement of notice period mentioned therein. It just indicates that the resignation is accepted. The relieving letter is the conclusive letter of acceptance of your relieving date mentioned therein. As suggested you need to first check your appointment letter for notice period clause.
Many companies now a days have started practice of issuing conditional acceptance letter which mentions that the relieving date will be decided later and of course the routine resignation procedure.

They did not issue me the offer letter too.neither the project manager nor the hr informed me to serve the notice period. And ceo of the company is saying that u doesn't know u have to serve notice period.for that reason u have been absconded from the company.

If there is no offer letter,then how did they ask you serve notice period?
You can state the same to them in a polite manner that they cannot force you to work without justification.
Speak to HR for the final dues.

I spoke to him politely only but he is not in a willing to speak to me.he is saying that I mailed u a offer letter but I asked to resend the same offer letter but he is not sending. Can I go to police station and lodge a complaint. And in my resignation letter I mentioned that I will serve notice period if any but hr said he will call me back but he did not turned up. I have proofs that I worked till so and so month in site attendance register.
