An employee who is looking for a better salary to opt for an expensive treatment and thus needs to switch her job as soon as possible as her medical condition is getting worse. The employee has no family support and thus in worst of conditions too, she has to continue working, though is a very good resource to the organization.
Can she get releived from her notice before completing two months on medical grounds. There is a policy in the company to pay for the period you are not serving the notice, do we have a law to protect employees from force paying on such occasions.
Kindly suggest.

Dear Rekha,
Your friend's case needs to be looked empathetically but within the context of the terms mentioned in the appointment letter. Whether to waive off those conditions or not is discretion of your management.
By the way your friend wants to quit the current employment. How come she will get leave for her medical treatment sooner she joins new company?
If she is important resource to the company then did she ask for soft loan for her medical treatment? I find this option more appropriate than quitting employment.

My friend is not actually in need of leaves but a job that allows her a little flexibility in terms of easing her life like better shifts, work from home, better infrastructure and other such things while she plans her treatment with better finances. Like I mentioned before, she is on her own and suffering from a chronic illness and thus can't risk taking loan with so much of uncertainties whether in sometime she will be able to continue or not.
She has been with this company for 9 yrs, and has been in this condition from last 5 yrs and needs a better infrastructure around to be able to cope up with her pains.

Thanks for replying anyway and clarifying certain things...i still wish to understand why there is no clause to relieve a person with so much suffering medically!

First of all, any company appoints a person in good health and after undergoing medical check-up and doctors certifies as fit to work. When your friends is suffering from chronic ailment, how she will work, unless you provide details it is difficult to come to a conclusion. As one of member put it across, it is better if she continues with the same company as that company accomdated her well inspite of knowing her condition.
