Hello,
Can anyone suggest what decision to be taken in situation when Mumbai is declared bandh ( due to heavy rains or any other situation ) and if few employees turn up to office and few could not come considering the transportation was affected due to heavy rains. In such situation those who could not make it will it be counted as leave ?? or that day's leave shouldn't be counted? and what about those who attended office ?

Dear Nikhat,
Probably your question relates to the situation of few employees' inability to report for duty on certain days due to lack of mobility caused by wide spread riots, torrential floods, earth quake and the like. When it is certain that this is an unpredictable calamitous situation beyond any one's control, the employer should automatically treat such employees' absence as leave only. Whether to pay wages for such days of absence is a matter of magnanimity as well as financial capacity of the employer in addition to the number of days of absence. No hard and fast rules can be laid down in this regard. After all, Safety of human life should get preference over production.
