one of our night duty employee was murdered at the workplace during duty hours. Now my query is that what is the management’s role to pay compensation to his family members.

Death of an employee at the woking place due to any unnatural cause is to be treated as a consequence of an accident arising out of and in the course of employment under the provisions of the Employees' Compensation Act,1923.. So, the management is liable to pay compensation to the murdered employee's dependent legal heirs as per the provisions of the Employees' Compensation Act,1923. Hence, let the management calculate the compensation amount and deposit the same with the Commissioner of Employees' Compensation for the area.

• When the watchman was found lying dead, it will be an accident for payment of compensation. Indian Iron and Steel Company Ltd. v. Bhim Mnya Chettri, 2009 LLR 46 (Cal He).

If the company or firm has registered under Employees state Insurance Corpn., and that employee is in the role, the corpn will pay the compensation. If the company is not registered, then the organisation is liable to pay with full settlement, eventhough he is the mustor role or not. : b.sekar

If found lying dead. this is accident or not, we r not declare after post-mart report if death due to heart attack he is not eligible for compensation.
Note - if death due to heart attack in second half of duty period then eligible for compensation

If there is an accident in company premises. Then 1st of all we have to check whether he is covering under ESI or not for payment of compensation. If he is covering under ESI Act. then compensation will be paid thru ESIc. If he is out of ESI coverage then Emplr is liable for its payment as per procedure given in table IV under compensation act 1923.

If the death is natural like heart attack, you have to check whether the employee covered under Esi or not. If not means the employee should get covered atleast by WOC policy. Through these policies you can literally compensate the loss.
If it is proved that the death was happened by un-natural way then you should pay the compensation also the claim made by the employees family. (if anything wrong in this means dear seniors please correct me.)

In my workplace my staff not covered under ESIC and EPF as we are only 5 staff. If we cover the employee under life insurance, then if his accident happen or death happen at workplace, will the insurance company pay his family death compensation or will i as an employer have to pay compensation to his family? please someone guide me. thank you.
