when employee is under suspension company will pay the Pf contribution or not, what is suspension rules & regulations. Suspension employee can he get the salary are not. please provide the information.

During the period of suspension an employee is eligible to get subsistence allowance at the rate of 50% of the salary (basic + DA). Depending upon the state rules, the rate of subsistence allowance may vary. As such, 50% is the rate for the first 90 days of suspension and if the suspension is extended beyond 90 days the subsistence wages will be 75% for the rest of the days.
There are two versions of deduction of PF from the subsistence allowances, that is, to deduct PF as if it is salary paid and not to deduct it for the time being and to collect it from the arrears of salary paid once the suspension is revoked and the employee is reinstated.

If the employer proves that the suspended employee is guilty of the charges levelled against him and then terminates from the employment, will the employer be required to pay any wages for the period of suspension of the employee? Please inform.

If the suspended employee is discharged from service, no more payment is to be made apart from the subsistence pay already paid. On the other hand, if exonerated of charges, he should be reinstated and full wages should be paid with retrospective effect from the date of suspension. While doing so, the subsistence allowance already paid shall be deducted from the wages payable.

My Dad's Worked a Tamilnadu State Govt Employee , Designation Village Admin officer. his retirement date 30-06-2008.on this date he got suspension ,regarding charge sheet issue (17B & 17E ). on 30-06-2008 to till date we get 50% salary only , can any one help in Tamilnadu act 53(1A) first 6 month 50% Salary Provided and remaining days 75% Subsidy Allowance Provided its applicable for my father ...plz help me any one ..
