Actually, one of my friends has been working in a company for the last 8 years. He has a very good relationship with his boss. However, due to the boss's old age, he no longer comes to the office, and instead, his 26-year-old son takes care of the entire business.

The boss's son is very short-tempered and mentally harasses all the employees. He has even physically injured some of them. Now, my friend wants to leave the company, but the boss's son threatens him, saying he will file a fraud case against him. My friend had signed on a blank paper with a revenue stamp on it last year and again yesterday. He was told that this signature was to confirm the receipt of Diwali Bonus, and all employees had signed it.

My friend is concerned that his boss may misuse this paper and write anything on it to frame him as guilty. He also mentioned that he did not date the signature. Could you please advise on the legal aspects? What actions can his new boss take, and how can my friend escape this situation of dirty politics?

The new boss does not even allow my friend to resign and continuously mentally harasses him. My friend is so frustrated that he is contemplating suicide. He feels trapped as he cannot quit the job, work properly, and the situation is also disturbing his family.

Additionally, could you please advise on how he can resign? Will there be any issues if he resigns without notice? Is there a legal procedure for him to get out of this situation, or will he end up being the scapegoat for his boss's dominance?

Please approach the Maharashtra Navnirman Sena local office these days as they are fighting against such nature of harassment. Do not hesitate to approach them, regardless of the propaganda factory of our modern age that may have portrayed them as evil forces. In reality, they are good, and you need to see their positive strength.

Have some proof for Harrasmnt n go to labour court, revenue stamp sign will be useful for only receipt of payment n tatz it. juz ask him to consult an advocate n resign.

Intimidation and harassment cannot be dealt with by labor laws. We used to keep workers away from joining the factory despite the labor court's reinstatement with back wages order for years, stating the worker is not reporting to work and subsequent dismissals. There are many tactical moves to victimize workers. Bribing a Labor Officer or conciliation officer is also one infamous act.

Other than this, we have many ways to force a worker, even transferring them to another site where they are not interested in working at all, just to harass and force them to resign.

This son of the proprietor has many means and ways to harass, despite the Labor Court and Law enforcement machinery having no teeth to bite him. The best way to treat such elements of society is with their own weapons.

You must approach appropriate social reformers who are capable of dealing with such people; such an employer shall have some respect and fear to take them on.

Don't follow a bookish approach; this will fail. There are some solutions that can only be practical in given circumstances.

I would suggest not to take a hasty decision. Do wait and see. First, understand why he is behaving like that. Is it because of the employee's mistake or his mistake? As you know, young-blooded people will expect employees to work hard and provide a quick turnaround time. Check if you are meeting his expectations or explain practical reasons why you are not able to meet them. Think in a positive way and try to get close to him. Don't share any office issues at home. If you find this very difficult, as you have been working at the same company, try to meet your ex-boss. I would suggest trying to talk to him and getting close with him.

I suggest going to the Police Station to file a NOC against your boss's intention that he can harm you physically, mentally, and financially. So, if anything happens to you, he is responsible for it. Also, mention to them that he has taken your signature on paper by threatening you physically.

As there is a famous proverb - "Tit for tat."

You should warn your boss that if he gives you any type of torture, you will commit suicide. Maybe he will also fear the impact on his reputation and the comments from his relatives.

I also suggest you talk to his father, mention the problem, and seek guidance from him.

For precautionary purposes, always carry a tape recorder when you anticipate that he will speak ill and threaten you. Never say anything wrong as it will be recorded on the tape. You can also use the latest mobile phone with a voice recording facility.

Sometimes we have to resort to cunning tactics. "JAB GHEE SIDHI UNGLEE SE NAA NIKLE, TOH UNGLEE TEDI KARNI PADTI HAI."

Hi,

My suggestion in this regard is to avoid a fight or argument with the owner because the boss is always right.

First, check where we are wrong. If we are not wrong, then go and ask directly with humble words to continue work because we cannot find enough time to fight in court. It's better if we are qualified; meanwhile, find another job and resign from the current one.

After finding the job, don't stop even if your boss requests it at any cost.

I think this will work based on my personal experience.

If we are so rich, why are we working for somebody else? Why not start a business? Even business is challenging, so try to bear it and take action if there is an opportunity.

Last but not least, I am working in a group of companies as a Manager of Finance & Accounts. There are four bosses, but I have been handling them since March 2007. If you are well-equipped, nobody will challenge you. If challenged, they will lose their best assets.

We discuss everything like philosophers and MBA students here on board. If your boss is assaulting the employees, then his criminal behavior shall be dealt with appropriate measures. His bonded labor kind of treatments, treating employees like medieval age slavery system used to be not appropriate to deal with labor laws.

If our HR fails to distinguish between formal labor laws and criminal acts, they exhibit inexperienced and poor judgments.

The problem with this post is its sensitivity and not frivolous, but our victims enjoy victimization. What can be done? He appreciates time-pass ideas that yield nothing in the end. At the end of the day, he remains where he was at the beginning. He does not understand that dignity and self-respect are greater than salary. Money can be earned but not at this cost. If the boss is assaulting and abusing him, he asks for solutions – what can be done? He is interested in stories, not in action.

Hi,

I believe your friend has a good relationship with his old boss (the father of the current boss), so he should contact him and inquire about the situation within the organization. He should find out the sentiments of the employees and where things are headed in the future. I suggest he discuss this with his son from the perspective of the organization and take necessary steps to prevent these issues because no entrepreneur wants to lose his business in this manner.

Here are a few options for your friend
  • He could meet his boss's father and explain the situation and get a solution for retrieving blank paper
  • He could organize riot in his company with his Union and with help from Social activists against harassment
  • He could befriend his new boss and gain his trust to know the secret of what happens to the blank paper
  • Arrange for a beautiful girl and some drinks to extract info on where he has hidden the blank paper
  • Find out new boss's weakness and exploit it to counter if boss misuses the blank paper
  • Meet the boss 's mother and seek her protection - all men are afraid of their mother
  • Go with a pistol (toy) and threaten to kill him (the boss) if he does not return the blank paper
  • Even if his boss misuses the blank paper ,your friend could always prove he was blackmailed to sign - call it signed under duress - which makes it invalid in the eyes of law.
  • Take his new boss to a temple and tell him moral stories and convince him that Gods don’t like arm twisting and it’s a terrible sin
  • Go to his boss's cabin and sit cross legged and casually ask him to return the blank paper if the boss shouts back your friend could just tell him that he has a letter waiting to be sent to Police that his boss is responsible if anything happens to him
  • Take some co workers to the boss, get him infuriated, make him assault one of them, record the incident in a hidden camera or voice recorder, blackmail the boss to turn this to Union or Police or court and trade it for blank papers
  • Get a new job, go to the boss with some dadas ,simply wriggle the blank papers out of his hands
  • Get a new job, preferably with a competitor, explain the problem to new company and seek protection if his boss retaliates

All of the above assumes that your friend is loyal, honest and has done no mistake. But if he is not then
  • He could fall at his new boss's feet and cry in helplessness ask to be forgiven and get back the blank paper, promise never ever to return to his company

I also assume that you really want to help your friend. If you happen to be the boss who took the blank paper from a worker and want to know what all your worker could do …God save you !
