Thanks for the information. The countries involved would mainly be in Europe, the Middle East, the Far East, and possibly the US. The operations would primarily be located in Bangalore. The focus of this venture is on providing engineering solutions for the oil and gas industry.

Hi Bala / Naina,

I would rather answer the steps sought by Naina, since it is listed step by step.

1. RECRUITMENT - this is a normal process (could be either you travel to meet the candidate abroad or vice versa or using Skype or any other e-tool to discuss, or use your own office folks abroad to meet the candidate, etc.) however, when you are very clear on the candidate, send the following documents, ask him/her to furnish a copy of his passport. Then send the following to him:

a. Employment Offer (the salary value needs to be in both foreign and Indian currency - example - You will be paid a gross annual salary of USD90,000 (i.e. 40,50,000 INR prorated payable on a monthly basis). This is essential because most of the Indian Embassies abroad insist on compensation values to be in INR. Also, add an important clause stating that 75% of the salary shall be credited to your overseas account in the required currency (after deducting the FE Commission and transfer charges) and the remaining 25% will be credited to an Indian Bank. Communicate to the prospects that you shall be facilitating the opening of a new salary account for them in India. In case they want to transfer a portion of that 25% also abroad, tell them that's their personal task, however, they can do that (through Western Union or something).

b. All other amenities such as Housing / Transport / Insurance, etc. need to be mentioned in INR (such as 'you will be provided a housing allowance up to INR 75,000 per month, etc.)

c. Employment Visa Invite Letter - This is a letter you draft to the Indian Embassy of your prospect's nation (like if you are hiring a Brit, then the letter should be addressed to the Visa Officer, Indian Embassy, Birmingham). The content of the letter should be, "Owing to the acute shortage of skilled personnel in your field, you are compelled to hire a foreign national to the mentioned role, which would alone help you to continue your business. Hence you are hiring Mr. Ms ________, nationality of ________, whose passport number is (______________) and request the embassy to grant him/her a valid Indian EMPLOYMENT VISA.

(please note that Business Visa is different from an Employment Visa and if you are hiring on your roles and if the company's registered address is in India, then it has to be an employment visa, otherwise you may end up in problems during renewal / tax declaration / in the event of the foreign national caught by police for something, etc.)

d. Also, the most important document to be sent is the copy of your company's Articles of Incorporation and Registration Certificate.

Using the above documents, the prospect will visit the Indian embassy in his country, get a valid E-Visa (this would not take more than 72 hours, provided the documents are intact). For Britain, he may need to fill in an online application and go through an agency. For countries where there is no Indian Embassy, he may travel to his nearest embassy. (this is more advisable because, for example, there is no Indian embassy in Bolivia. The nearest is in Peru or Venezuela. If he submits to High Commissioner or Cultural Attache office in Bolivia, this would be verified by that office first, then couriered to the respective nearest location. They, in turn, would validate through paper mails and this process may take a few weeks, hence better is him/her travel in person and get done in less than 3 days).

TRAVEL PLAN - This would be better if you guys spend some time on looking into various routes and get a cheaper / effective one. Travel Agencies sometimes might take you for a ride. For example, from Dar es Salaam, Tanzania to Bangalore may cost you 160,000 INR one way, if you put him on the route Dar es Salaam - Dubai - Bangalore, whereas, this could be less than INR 60,000 if you book Dar es Salaam - Nairobi - New Delhi - Bangalore (here you might need to ask him to book from Dar es Salaam to Nairobi a local ticket and you may book from Nairobi to Bangalore at 46,000 INR).

AFTER REACHING INDIA - The last thing he/she needs is a Residential Permit in India. This should be obtained within 14 days of the arrival of an Expat in India from the FRRO (Foreign Residents Registration Officer) in Metros or Police Commissioner Office in other state capitals. The documents needed for this are:

a. Application Form (which you may get in FRRO / Commissioner office - for Hyderabad alone this process is online - you need to fill an online form, take a print out, paste a picture, and sign across the picture - for other cities paper/pen applications).

b. Copy of Employment Contract.

c. Passport Copy.

d. Visa Copy.

e. Undertaking Letter (to be drafted and signed by the authorized signatory of your office/ This should be in a standard format with contents stating - 'you have hired so and so for so and so position and you assure that he/she abides by Indian laws, failing which you take the responsibility of repatriating at your cost).

f. Copy of your Company's Registration Certificate and Articles of Incorporation.

g. ACKNOWLEDGEMENT FOR THE PAN CARD APPLICATION (on day 2/3 of his/her arrival get him filled for a PAN Card and get the acknowledgment).

The foreign national has to meet the FRRO (or competent authorities) and apply for this. They would grant him the residential permit in 2 days' time.

For the last question on TAXING - no matter what it is, they have to pay taxes at 33.9%; however, there is no dual taxation, that means, they do not have to pay taxes in their home country.
