A Pvt. Ltd Company was registered last month and allotted a 17-digit ESI code. Can an ESI challan be generated by the due date? The employees' ESI codes have not been applied for yet. Therefore, the due ESI contribution can be deducted from the last month's salary and deposited with the ESI.

My question is, as of today, employees' codes have not been applied, so can the ESI contribution be paid to the ESI Department?

It is the duty of the employer to collect the details of employees and their families, upload the information to the portal, and generate TIC. The employee will only provide data to the employer; employees cannot apply for or generate their membership themselves.

Employees receive an IP number, which is generated by the employer after providing data on the portal for each employee. Employees are not assigned a code; the code is for the establishment responsible for deducting and paying contributions along with the establishment's contribution.

Furthermore, if the employer has not yet uploaded the employee details or generated the TIC, can the employer deduct the ESI contribution and deposit the same with the ESI department? Or should the contribution be deposited after obtaining the TIC and employee IP number?

Dear All,

Pvt. Ltd. Company has an ESI code. Now, the employees' details with photos are to be uploaded to obtain the IP number online. Therefore, the contribution is to be deposited to the ESI department after obtaining the IP number of employees or it can be deposited before as well.

Ignorance is "not" always bliss.

Employee has to submit the personal Aadhar and family Aadhar copies along with the relationship details, employee's bank account information, and date of birth of self and family members. The employee has the option to select any specified ESIC dispensary, which should be mentioned in the declaration form (ESIC) as the preferred dispensary, if available.

ESIC does not provide a space for photo upload. However, the employee must submit a photograph with family members duly attested by the employer, along with TIC validation, and visit the dispensary/ESIC hospital for biometric authentication of self and family members. Until the verification is completed, the status will show as "unverified."

The employer is required to pay contributions from the month of registration itself. Failure to submit TIC will not exempt the employer from statutory liability. In such cases, the employer may face penal proceedings, along with interest, damages, and contribution payments.
