Greetings to all!
One of our employees was fired from the organization because of misconduct in June 2016. The next month, his name was de-registered from EPFO and ESIC records. Upon his further requests and due to certain reasons, the administration agreed to rehire him for the same position with all the previous conditions. He is likely to rejoin the job from October 2016.
Now, I would like to inquire:
i) Is there any specific time period that dictates when an ex-employee is prohibited from rejoining the same organization for a certain number of months?
ii) What about his UAN, i.e., would he be assigned a new member ID for PF purposes?
Please explain and suggest what occurs in such a circumstance.
Thank you,
Kumar Avi

@sandeepedp, do not try this, as it will cause a service break. The date of exit has already been submitted, and it will create a lot of hassle to add old funds to new fund contributions.
When you allot him a new number and later link it with the old UAN, it will ask for bank account and Aadhar/PAN details. If both have been verified earlier, the transfer will be auto-clicked. If the KYC is not updated, you can do it right now before linking his UAN to the new allotted EPF number.

If the employee has not withdrawn the PF accumulations, it is advisable to allot him the same PF number and UAN and make the future contributions to the same account. The two months period during which he was not in service will be treated as "non-contributory period".
In the case of ESI also, use the same IP registration number and continue contributing. This will enable him to get the benefits due to him against his previous contribution period.

I have been very practical regarding such issues. The data from the previous employment term is not digital but manually submitted, so there are chances of errors, such as name spelling mistakes, relation names, etc.
Additionally, can the person dealing with EPF assure to remember the broken service record when preparing the Form 10D enclosures? Once a new number is allocated with the correct data as per Aadhar and PAN numbers, and the bank account is seeded in the previous UAN, when the employer confirms the old UAN and submits the already seeded bank details and PAN or Aadhar data, Form 13 is automatically processed, transferring it to the new account. Thus, spelling mistakes and other errors are automatically omitted.
However, if the person handling day-to-day EPF tasks can keep notes for broken period records and make them available at the time of filing claims, they should do so. Digital record-keeping is always preferred over manual record-keeping, which is why the transfer is preferred.
