If an employee opts to continue membership when his salary increases above Rs. 21,000, do both the employee and employer have to contribute? And on what amount should the contribution be calculated - on the increased salary or up to Rs. 21,000?

In ESI the salary limit enhanced to Rs.21000 from Oct.,2016. The ESI Contributions rates and calculations will remains same.

Sir,

Should we start implementing a process to inform employees, or should we await the notification? In case of notification, implementing it effective from 1st October 2016 will be difficult. Management definitely would not like to increase the CTC, and employees will not want to reduce their NTH, which will lead to a time loss in arriving at a common ground.

Dear Seniors/Experts,

The government has not yet published these changes in the gazette. Should we wait until the notification comes, or can we go ahead and implement it from 1st Oct'16? We are expecting a few people to join our organization and are confused about whether to put them under ESI or GMC. Can you please clarify?

Sir,I think, it will be more appropriate if you can confirm the position from the concerned office of ESIC to which your unit is attached and take action accordingly.

Dear All Experts,

I need guidance/advice on ESIC. We are an NGO present in 5 locations. ESIC is now applicable in one location, Nainital. We have recently been notified about this and are in the process of ESIC registration. All our employees are registered for PF in the same location, Nainital.

My queries are:
1. Do we have to register only Nainital employees or also the rest who fall under the ESIC category (earning less than 15k)?
2. Is the contribution submitted with arrears or is it effective from the day of registration?
3. ESIC is not applicable in the rest of the locations except Mumbai. As only one employee is in Mumbai, do we have to register him there?

1. Sir, please indicate where the head office/registered office of your NGO is located. Is it situated in an area that falls under the purview of the ESI Act, and is the said Registered/Head Office covered under the Act?

2. What are the business activities of the NGO that led to the branch in Nanital being covered?

Thank you for sharing the copy of the draft Gazette Notification. The final notification may take a minimum of a month's time, and I hope it will not be effective from a retrospective date.
