Need: Intimation letter format to ESIC. If in one of our branch offices, there is an employee covered under our ESI-Sub code who has resigned, what is the procedure to intimate ESIC officials?

There is no employee covered under ESIC, and contribution has not been calculated since May 2016 as our covered employee resigned in April 2016. We have marked him as resigned in May 2016 with zero (0) working days under the category. Kindly suggest the procedures and what to do.

1. Sir, if at present, you have no covered or coverable employee under the ESI Act, 1948, and the rules/regulations framed thereunder, then you can send a NIL contribution return after the close of the contribution period to the Regional Office as well as the concerned Branch Manager. You can also inform the said department by a simple letter, including their social security officer. Non-submission of any such return or information may cause the department to presume that you are a defaulter, and ESIC can resort to ad-hoc assessment under section 45A.

2. However, as and when you employ covered/coverable employees again, compliance will be required.
