Hi Praveen,
Here are the details that you asked for on citehr.
The formalities for ESI are that you must have a minimum of 20 employees, regardless of whether they are earning a salary of more than 10000/- or less. The maximum ceiling for ESI contribution is up to 10000/- Gross/Month only. Those earning 10001/- or more will be exempted from ESI contributions.
Yes, ESI and ESIC are the same. ESIC stands for Employee State Insurance Corporation.
The employer should register the factory or establishment with the ESI Corporation within 15 days of the ESI Act's applicability. The registration declaration should be filled in form 01, along with a separate sheet containing the establishment's name and address, number of employees, nature of duties, and the name, designation, and address of the controlling manager for offices located outside. Once the application is approved, the ESI regional office will assign a code number to the employer.
Only after this registration can the employees be registered with ESI. They need to fill out a declaration form FORM 1, clearly stating their gender. All declaration forms should be countersigned by the employer.
Next, prepare a return of declaration in form 3 separately for male and female employees within 10 days of filling out the declaration form.
Each employee will then be assigned a temporary identification number.
For PF formalities, the company must be at least 3 years old before it can be registered with the PF department. Similarly, for this Act, the minimum number of employees required is 20.
Every employer covered under the Employee Provident Fund Act should submit particulars of all branches, departments, owners, directors, partners, or other controlling individuals in Form 5A (in duplicate) to the commissioner within 15 days of the scheme's applicability.
Upon receiving Form 5A, the commissioner will verify the submitted particulars and, upon satisfaction, allocate an Establishment Code No.
I hope everything is clear now.
Regards,
Amit Seth.

Hi Amit,
I have another doubt. If an organization is deducting PF before getting itself registered, can that amount be submitted after obtaining the establishment code number? How much time does it take to register the company from the day of submitting all the documents, considering that all other eligibility criteria are fulfilled?
What should be done for an organization that deducts PF from employees but does not deposit the amount?

Sashmita

Hi, Sashmita,
As soon as a company reaches the eligibility criteria, it must be registered with the same. Otherwise, you are required to pay the penalty. Generally, it takes 10 to 20 days to get the registration.

Dear Sashmita,
It happens mostly with those employees who are getting more than 6500/- rupees as Basic. They are generally asked for consent. Otherwise, as far as I know, if a company is registered with the PF department, then they have to update the list with new members after joining.

Dear Amit,
Please clarify below:
As you mentioned, if a company is required to be 3 years old, this means that any new start-up company with a staff of 30 or more does not need to apply for provident fund contributions for up to 3 years.
Even after 3 years, if the total number of permanent employees reaches 10 to 15 individuals and the rest are still on probation, does the company need to implement a provident fund scheme?

Dear Bankim,
After an amendment in the PF Act, it is now required to be registered under this Act as soon as the employee strength reaches 20 or more. However, if the number remains below 20 even after 5 years, then registration with the Act is not required.

Amit Seth.

Dear all,
I have some confusion regarding the Provident Fund. As we know, 12% of the basic salary is deducted for PF, with contributions of 13.61% from the employer and 12% from the employee. I would like to understand how much money is kept in the PF account and what amount we would receive upon withdrawal. Is it double the amount we contribute?
Kindly assist me in understanding this matter.

My friend is a general manager in a 3-star hotel. During his tenure, he did not create any PF account. Now, he is planning to leave his current job and join a new job. How can he collect his PF from his old employer? Please assist, and I would appreciate a prompt response. Thank you.

Hi,
Firstly, an employee needs to have a PF Code, which may be mentioned on his salary slip or pay slip. Secondly, if he has not filled out any PF form, he has to first inquire and ask if he has been allotted the PF number or not. If yes, he can even collect the PF withdrawal form from the EPFO office, fill it, and submit it to the previous employer. However, if he is joining somewhere else, then his PF has to be transferred from his previous employer to the new employer. For transferring, the new employer assists in the process.
Please note: To withdraw or transfer the PF amount, an employee must be aware of his PF number.

My company is US-based, and the India operations started only last December. The registration of the India office was completed only last year. Do we have to wait for 3 years to be registered with PF, or can we proceed with our 20 employees? Please guide.

Dear @AMPSYS,
If the number of employees is less than 20 and the employer and employees wish to take advantage of the provident fund, then voluntary provident fund registration is applicable along with the consent of all existing employees.
