I was working in one MNC for the last 3 years, but due to certain reasons, I had to quit the organization without completing exit formalities. They had not given me relieving and experience letters. Now, I want to withdraw my PF amount. I don't expect anything from my previous organization, even though I know that if I send a PF transfer request through my new company, they will not proceed with it.
Please, please tell me how I can withdraw my PF amount. Within how much time do I have to submit a request for PF withdrawal? What do I have to do as per the legal rules?
Please suggest to me.

Hi,
If you are interested in a transfer, please fill out Form-13 through your present employer and deposit the same to the concerned RPFC office in which jurisdiction your present office falls. There is no need to send the request to your previous employer.
Secondly, if you are interested in withdrawal, fill out Form-19 & 10C and send them by registered post to the concerned RPFC office where your ex-employer deposited the PF along with the request.

You may need to get the Form-19 and 10 C attested by any gazetted officer and send them to the concerned office of RPFC/APFC with a withdrawal request. You must mention the fact that your employer is not attesting the forms due to some unjustified reasons.

There is no time limit for the submission of PF withdrawal forms, but the sooner you submit them, the sooner you will receive the amount. The withdrawal forms can be attested by your bank manager, besides a gazetted officer/MLA/MP, etc. You need not mention any reason for your forms not being attested by your past employer.

Just fill out Form 19 & 10C accordingly, and attach a photocopy of your bank passbook. If it is not signed by the previous employer, it should be attested by a gazetted officer before submitting it to the RPFC.

1. PF Withdrawal upon resignation :
Upon resignation an employee can either withdraw or transfer his/her PF amounts at his desire.
a) For Withdrawal: In order to withdraw the PF/ Pension funds you have to submit form 19 and 10 C preferably through your employer. Depending upon the attitude and working capabilities of employees in the respective EPF Office, it will take 45 to 60 days to get your balance credited to your bank account.Withdrawls of PF can be done only after 60 days period after resignation.
Form No 19 is for Provident fund withdrawal & Form No. 10 C is for Pension scheme withdrawal. I have attached both the forms for your reference.
b) For Transfer : For transfer you have to get form 13 submitted through your present Company but you need to know your earlier PF a/c no.etc.
Also you need to provide following details to your current company.
• Name and address of the previous company from which PF is still pending to be claimed.
• Group Code of the previous company.
• Date of Joining and date of leaving from previous company.
• Your PF no from the previous company.
2. PF withdrawal during Working period :
The Provident Fund members can avail advances / partial withdrawals subject to certain conditions like Marriage for self and dependant sisters, brothers etc / purchasing of dwelling house or repayment of housing loan / specified medical treatments / Closure of establishment etc.,
You need to submit FORM 31 for claiming amount. But the PF authorities will sanction only if you satisfy the qualifying conditions. I have attached a document " Guidelines for PF withdrawal" that gives you an clear idea like on what grounds can a employee withdraw PF during his/her working period.

In case the reason for leaving and withdrawal of PF is leaving India, there is no need to wait for two months. No documentary evidence is required to be attached, but it would be proper if you attach a copy of the VISA along with the application.
The waiver of the two-month waiting period is not applicable for female employees who resign after getting married.

Around 3 months back, I left my employer, and on my last day, I had completed 4 years, 11 months, and 14 days in that organization. As I moved to a government organization, I need to withdraw my EPF. So I have a few queries if someone can help me out:
1. As I have not completed 5 years (heard that if tenure is 5 years, then no deductions are done in case of withdrawal) by the last day in the organization, would the complete amount be provided to me, or will some deductions be done when the amount is withdrawn? If yes, then how much?
2. As you can see, I was just 15 days short of completing 5 years, so the time (past 3 months) will also be included in the tenure and help me complete the 5-year duration?
3. What is the time duration until which I can keep money in my EPF and still get the interest getting paid to me?
4. Suppose I decide to keep my amount in my EPF account (do not withdraw) for around 2 years, and in the meantime, my previous organization shuts down, then does it somehow risk my contribution to EPF, or will that remain secured?
