Hi, If an employee takes leave from 13th Aug 12 to 18th Aug 12 total no. of leaves is 8 days. In that 15th Aug 12 is Govt. holiday that day is LOP or paid holiday & mention rule also. Regards Sivaram

Dear Sivaram,

For the purpose of working days, it includes only the working days of the employees and excludes any festival holidays, leave, without pay, or any other kind of absence from work. The holiday days are counted only for the purpose of maintaining the continuity of the employee's job.

Though leave rules differ from company to company, all holidays/weekly off days coming in between the casual leaves are counted as holidays or weekly offs, as the case may be. Therefore, if the 14th and 16th of August were casual leaves, then only two casual leaves will be debited as availed, and the holiday would be paid. However, if the employee has been on Leaves without pay, Earned leaves, or sick leaves, then the holidays or weekly off days intervening shall be treated as leaves. In the latter case, the holiday or weekly off coming in between two earned leave/LOP/Sick leave will be counted as EL/LOP/SL.

Continuing the same example, if he has taken leave without pay, the holiday will be without pay, and if he has been on EL or SL, then the holiday will be marked as EL or SL, as the case may be.

What do your leave policies say? Follow them accordingly.

As per statutory compliance, if any employee avails leave on both preceding and succeeding days, then weekends and national holidays shall be treated as holidays. Some organizations follow the same procedure, while a few, due to the welfare of employees, will not consider it as leave. It's left to the management.

Dear Sivaram,

1. Leave from 13th to 18th means a total of 6 days.
2. If any staff takes leave between holidays, like from the 13th to the 18th, then the 15th is also considered as leave, whether it's a National holiday, a weekly off, or a festival holiday.

Hi Sivaram,

As already mentioned, it depends on your company's leave policy. Most companies consider the total number of days an employee is absent from work as leave. However, there are exceptions; for example, I am aware of a Japanese company where they only count working days. For instance, if a person takes leave on Friday and Monday, only 2 days are counted as Saturday and Sunday are not considered since they are non-working days.

Yes, Anita is right. Meanwhile, please check your company's leave policy to determine if Suffix or Prefix is included. Depending on this, you can decide the number of days of leave availed by the Employee.
