ESIC Covered - Maternity Benefits?

Dear All,
One lady joined us two months back. She is covered under ESIC.
She is asking for Maternity leave now.
What are the benefits to her under ESIC?

Under ESI she can get treatment
She is also eligible for Maternirty Benefits for 84 days after completing contribution for specified periuod Kindly check on the specified period.

The question asked is primarily related to entitlement of Maternity Leave. In this connection I would like to say that a female employee whether permanent or contract, even trainee or casual labour are entitled for maternity leave. Dear friend,
The employee is elegible for maternity (medical) treatment in ESI Dispensary (or at ESI hospital if forwarded by dispensary) with medicines and even delivery treatment free of cost - on production of esi identity card. For monetary benefit payable by esi for the absence period of 84 days, she is not elegible.

Women indulging temporary of unmarried are eligible for maternity benefit when she is expecting a child and has worked for her employer for at least 80days in the 12months immediately proceeding the date of her expected delivery.

Condition for eligibility of Benefits:

1) Ten weeks before the date of her expected delivery, she may ask the employer to give her light work for a month. At that time she should produce a certificate that she is pregnant.

2) She should give written notice to the employer about seven weeks before the date of her delivery that she will be absent for six weeks before and after her delivery. She should also name the person to whom payment will be made in case she can not take it herself.

3) She should take the payment for the first six weeks before she goes on leave.

4) She will get payment for the six weeks after child-birth within 48 hrs of giving proof that she has had child.

5) She will be entitled to two nursing breaks of fifteen min each in the course of her daily work till her child is fifteen mts old.

6) Her employer cannot discharge her or change her condition of service while she is on maternity leave.

A woman worker covered under the ESI Act is eligible to get maternity benefit from the ESI Corporation provided she had contributed at least for seventy days during two consecutive contribution periods immediately preceding confinement.
Under the Maternity Benefits Act, a woman worker is eligible for benefits if she had worked for 160 days during the 12 months preceding the date of delivery.
The liability of payment of benefits will be on the employer if she is uncovered by ESIC.

Hi All,
Just to add to the query of Ash.
There is a friend of mine who works in a company with only 8 staff. She has served the company for 4 yrs but the company is not ready to give her Maternity Benefits. As per her company, as ESIC is not deducted from her salary she is not eligible for Maternity Benefits.
Is the above statement from the company true?

An organisation employing 8 employees is not covered under the ESI and hence she will not get benefit form ESIC. Such an organisation MAY not come under the purview of the Maternity Benefit Act also. In order to be made the Act applicable, the establishment should be such as specified in section 2 of the Act.
