ESIC applicable in Gross rate or earned gross salary - due to his 15 days absence he earned gross Rs 13,000/-

Mr. A is not member of ESI till Oct-24. His Gross salary is 26,000/pm

In Nov-24 due to his 15 days absence he earned gross Rs 13,000/-

Then is ESI is applicable to him from Nov-24.Please Suggest

For coverage under ESI, the notional wages or the gross salary for 30 days (per month) should not be more than Rs 21000. In this case it is the earned wages for 15 days which is Rs 13000 but the notional wages or the wages which he would have earned if he had worked for 30 days is Rs 26000. Therefore, he is not to be covered.

If gross salary is more then Rs.21000/-pm the the employee is exempted employee. ESIC will not deduct from his salary if he has worked 15 days or less.
